Overview
Welcome to NASS Shop. The terms "we", "us" and "our" refer to the National Axial Spondyloarthritis Society (NASS), a registered charity in England and Wales (1183175) and Scotland (SC049746). NASS operates this online shop and website, including all related information, content, features, tools, products and services (the "Services").
NASS Shop is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with our Privacy Policy and Refund & Returns Policy, describe your rights and responsibilities when you use the Services. Please read them carefully.
By using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
Nothing in these Terms affects your statutory rights as a consumer under UK law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Section 1 – Access and Account
By using the Services, you confirm that you are at least 18 years old. If you are under 18, you may only use the Services with the involvement of a parent or guardian.
To make a purchase, you may be asked to provide certain information, including your name, email address, billing, payment and shipping details. You confirm that all information you provide is accurate, current and complete.
You are responsible for maintaining the security of any account credentials and for all activity under your account.
Section 2 – Our Products
We make every effort to display our products accurately. However, colours and appearance may vary slightly due to your device screen and settings.
All our products are produced using a print-on-demand model. This means each item is individually printed and fulfilled by our third-party production partner, Printful Inc., once you place an order. As a result, each item is made specifically for your order and production typically begins shortly after purchase. This process allows us to reduce waste and offer a wide range of products without holding physical stock.
By placing an order, you acknowledge that your name, shipping address and order details will be shared with Printful for the purpose of producing and delivering your order. Printful's privacy policy can be viewed at www.printful.com/policies/privacy.
Product descriptions, images and availability are subject to change without notice. We reserve the right to discontinue any product at any time and to limit quantities.
Section 3 – Orders
When you place an order, you are making an offer to purchase. Your order is not accepted until we send you an order confirmation. We must receive and process your payment before your order is accepted.
We reserve the right to decline or cancel any order at our discretion. If we cancel an order, we will notify you and issue a full refund.
Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests once an order has been accepted and sent for production.
Your purchases are subject to our Refund & Returns Policy.
Section 4 – Prices and Payment
All prices are displayed in pounds sterling (GBP). NASS is not currently VAT registered and therefore VAT is not charged on purchases. Shipping charges are calculated at checkout and shown before you confirm your order.
Prices are subject to change without notice. The price charged will be the price shown at the time you place your order.
You agree to provide accurate and complete payment information. You confirm that you are authorised to use the payment method provided.
Section 5 – Shipping and Delivery
We currently ship to the United Kingdom only.
All delivery times shown are estimates and are not guaranteed. We are not responsible for delays caused by the shipping carrier or events outside our control.
Under the Consumer Rights Act 2015, the goods remain at our risk until they are delivered to you (or to a person you have nominated to receive them). If your order is lost or damaged in transit, please contact us and we will arrange a replacement or refund.
Section 6 – Intellectual Property
The Services, including all text, images, graphics, logos, trademarks, product designs and content, are owned by NASS or our licensors and are protected by UK and international intellectual property laws.
You may use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, or create derivative works from any content on the Services without our prior written consent.
The NASS name, logo and associated branding are trademarks of the National Axial Spondyloarthritis Society. Shopify's name, logo and branding are trademarks of Shopify Inc.
Section 7 – Third-Party Tools and Services
The Services may include access to tools or features provided by third parties. These are provided "as is" and we make no warranties regarding their availability or functionality.
Your use of any third-party tools is at your own risk and subject to the third party's own terms and conditions.
Section 8 – Third-Party Links
The Services may contain links to third-party websites. We are not responsible for the content, accuracy or practices of any third-party websites. Accessing third-party websites is at your own risk.
Section 9 – Relationship with Shopify
NASS Shop is powered by Shopify. However, all sales and purchases are made directly with NASS. By using the Services, you acknowledge that Shopify is not responsible for any aspect of any transaction between you and NASS, including any loss, injury or damage resulting from products or services purchased through the Services. You hereby release Shopify and its affiliates from all claims and liabilities arising from your transactions with NASS.
Section 10 – Privacy
All personal information we collect is processed in accordance with our Privacy Policy and applicable UK data protection law, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
NASS's main privacy policy can be viewed at https://nass.co.uk/privacy-information-notice/. This policy also applies to the NASS Shop.
When you place an order, your personal data (including name, shipping address and order details) will be shared with our fulfilment partner Printful Inc. and our e-commerce platform Shopify in order to process, produce and deliver your order. Please review Printful's privacy policy at www.printful.com/policies/privacy and Shopify's privacy policy at www.shopify.com/legal/privacy for full details on how they handle your data.
Section 11 – User Content and Feedback
If you submit any ideas, suggestions, feedback or reviews ("Feedback"), you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, modify and display such Feedback for any purpose related to the Services.
You confirm that any Feedback you submit is your own, does not infringe any third party's rights, and does not contain unlawful, offensive or harmful content.
We reserve the right to remove any Feedback that we consider inappropriate, offensive or in breach of these Terms.
Section 12 – Errors and Inaccuracies
Occasionally, information on the Services may contain typographical errors or inaccuracies relating to product descriptions, pricing, promotions or availability. We reserve the right to correct any errors and to update information or cancel orders if any information is inaccurate, without prior notice.
Section 13 – Prohibited Uses
You may only use the Services for lawful purposes. You must not:
(a) use the Services for any unlawful or fraudulent purpose; (b) infringe upon the intellectual property rights of NASS or any third party; (c) transmit any viruses, malware or harmful code; (d) harass, abuse or harm any person, including NASS staff or volunteers; (e) attempt to gain unauthorised access to any part of the Services; (f) use the Services to send unsolicited advertising or spam; or (g) collect personal information of other users without their consent.
We reserve the right to suspend or terminate your access to the Services if you breach these Terms.
Section 14 – Termination
We may terminate or suspend your access to the Services at any time, without notice, if we reasonably believe you have breached these Terms.
Upon termination, the following sections shall continue to apply: Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law.
Section 15 – Disclaimer of Warranties
To the extent permitted by law, the Services and all products offered through the Services are provided "as is" and "as available" without any warranty of any kind, whether express or implied.
Nothing in this section affects your statutory rights as a consumer under the Consumer Rights Act 2015 or any other applicable UK legislation.
Section 16 – Limitation of Liability
To the fullest extent permitted by law, NASS, its trustees, employees, volunteers, agents, contractors and Shopify shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Services or any products purchased through the Services.
Nothing in these Terms shall exclude or limit our liability for:
(a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any breach of the terms implied by the Consumer Rights Act 2015; or (d) any other matter for which it would be unlawful to exclude or limit liability.
Section 17 – Indemnification
You agree to indemnify and hold harmless NASS, Shopify and their respective affiliates, officers, employees, agents and volunteers from any claims, damages, losses or liabilities arising from:
(a) your breach of these Terms; (b) your violation of any law or the rights of any third party; or (c) your use of the Services.
Section 18 – Severability
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the remaining provisions shall continue in full force and effect.
Section 19 – Entire Agreement
These Terms, together with our Privacy Policy and Refund & Returns Policy, constitute the entire agreement between you and NASS regarding your use of the Services and supersede any prior agreements or communications.
Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Section 20 – Changes to These Terms
We reserve the right to update or amend these Terms at any time. The most current version will always be available on this page with the date of the last update. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms.
Section 21 – Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of England and Wales.
